A neighbor of the proposed building now satisfied with the plan.
Alan Zanotti has withdrawn his appeal of a Zoning Board decision to allow American Legion Post 40 to replace its building off Federal Furnace Road. Zanotti and Ed Angley, the attorney prepresenting the Post, issued a brief statement Thursday. “Alan Zanotti and the American Legion have reached an agreement that will end the appeal," the statement says. "Alan Zanotti had filed the appeal to preserve his rights until the agreement could be finalized. The Amercian Legion is now free to pursue its building plans, and the parties look forward to friendly and peaceful, neighborly coexistence.” Last spring, Little West Pond innundated the Post's building. One neighbor of American Legion Post 40 has filed an appeal in superior court against the town for permitting a replacement building.
When the Zoning Board of Appeals unanimously approved a request by the American Legion to replace its condemned building, board chairman Peter Connor told the crowd of Legionaires, "Go build your building." A moment later, abutter Alan Zanotti told Patch, "We have an agreement we've worked out. Everything will be fine." The town received notice Tuesday that Zanotti had appealed the Zoning Board's decision. The appeal contains generic language about the board exceeding its authority. Ironically, the night of the decision, Jan. 19, the board stepped back from placing more conditions on the approval. The Zoning Board approved plans for a new American Legion Post 40 hall.
A sometimes contentious process ended Wednesday night when the Zoning Board approved the special permit allowing the American Legion to raze its current pond-side building and construct a new one further from the water. "Go build your building," Chairman Peter Conner said to the American Legion members who crowded into a town hall meeting room. The crowd cheered. While the new building plans promise to improve to the water quality of the pond, provide additional parking and create new landscaping, neighbors took the opportunity of the public process to air their grievances about noise. American Legion Post 40 needs to replace its drowned home, but neighbors object to living next to a "nigh club."
Last spring, Little West Pond exceeded its banks, flooding Federal Furnace Road and the American Legion hall. The water receded somewhat, then the mold took over. The town's building inspector declared the building unfit for human occupation. Members of the Post have spent thousands of dollars on a plan to raze the old building and construct a new one 80 feet from the pond. The plan would replace the old septic system, create a storm water drainage system for the first time on the site, improve landscaping and better the site lines for drivers. Lee Hartmann, director of planning and development for the town, sees in the plan great improvements for the site and the health of the pond. He also sees no violation of the town's zoning bylaws …

I am very surprise by all of this concern for the American Legion Post 40. The priority should be get that building out of the pond. Then let them rebuild with the conditions set forth by our zoning board. We as a community should better support the American Legion Post 40.
